Complete terms of purchase

1. BIDDING

1.1 Participation in bidding takes place with customer number and password obtained after application. Bids submitted are binding.

1.2 The buyer will be the one who at the end of the auction has submitted the highest accepted bid. If two bidders have placed the same bid, the first bid placed is the winner.

2. ABSENTEE BIDS

2.1 Participation in bidding can also take place by submitting tenders that are submitted in writing to Olséns Auktioner.

2.2 Upon submission of a call for tenders, identification must be presented. Olséns Auktioner reserves the right to disregard tender orders if the client is not deemed to have the ability to pay for the bid submitted.

2.3 Olséns Auktioner treats absentee bids confidentially and bids on behalf of the client as favorably as possible.

2.4 The buyer will be the one who at the end of the auction has submitted the highest bid. If two bidders have placed the same bid, the first bid placed is the winner.

2.5 Olséns Auktioner is not liable for damage that may be incurred by the client if Olséns Auktioner neglects to perform an absentee bidding assignment.

2.6 The client is responsible for purchases registered on the basis of an unclear or incorrect call assignment.


3. ESTIMATED PRICE

An item's asking price is based on a market-adapted valuation of the item performed by Olséns Auktioner. The asking price only serves as a guide and the price at which an item is sold can differ significantly from the asking price.


4. FEES ON PURCHASE

4.1 When buying, a call-in fee of 25% incl. VAT on the clubbed amount and a strike fee of SEK 80 incl. VAT.

4.2 In accordance with the Act (1960: 729) on copyright in literary and artistic works, droit de suite / resale right is added with a maximum of 5% of the clubbed price on the sale of works of art, ceramics, glass, silver, furniture and textiles. Only copyrighted works are covered. Copyright protection lasts for 70 years after the year an author died. Excluded from the droit de suite are sales not exceeding 5% of the price base amount as well as applied art objects produced in several identical copies. Works covered with droit de suite are marked with a D in connection with the cataloging.


5. RESULTS

5.1 It is up to the buyer to check whether the call assignment has led to the purchase.

5.2 Buyers will receive a confirmation of the purchase after the auction, either by e-mail or by letter, or there is a confirmation and invoice available under My pages.



6. PAYMENT

6.1 Payment can be made to our plusgiro 194 44 65-2. Enter customer number when paying. Payment can also be made by card on the website or in our premises. We do not accept American Express or cash. Payment must be made within 7 days after the auction.

6.2 If payment has not been made in time in accordance with section 6.1, Olséns Auktioner has the right to take one or more of the following measures:
(i) Cancel the purchase.
(ii) Demand payment.
(iii) Debit SEK 50 in reminder fee.
(iv) Charge default interest of 2% per month
(v) Resell the item on behalf of the buyer without special notice to the buyer. Olséns Auktioner has a full and unrestricted right to determine the asking price and whether the item is to be assigned a security price or not.
Olséns Auktioner has the right to deduct compensation from the amounts received for all receivables that Olséns Auktioner has towards the buyer.

7. COLLECTION

7.1 Purchased items can be picked up as soon as full payment has been made and Olséns Auktioner has received them. Items must be picked up within 7 days after the auction.

7.2 For items that have not been picked up on time according to item 7.1, a storage fee of SEK 50 incl. VAT, by auction item and calendar day.

7.3 Olséns Auktioner's responsibility for the care of the items ceases if collection has not taken place in time according to p. 7.1.

7.4 For items that have not been picked up within 7 days after the auction, Olséns Auktioner has the right to take the following measures:
(i) Delivery of items to warehouse at any forwarding company. All transport and storage costs are charged to the buyer.
(ii) Resale of the item on behalf of the buyer without special notice to the buyer.
Olséns Auktioner has a full and unrestricted right to determine the asking price and whether the item is to be assigned a security price or not. Olséns Auktioner has the right to deduct compensation from the amounts received for all receivables that Olséns Auktioner has towards the buyer.

7.5 All transports of items to the buyer take place at the buyer's expense and at the buyer's risk. Transport fee is charged according to the current price list.

8. RESPONSIBILITY FOR ERRORS

8.1 All items are sold in existing condition. It is the buyer's responsibility to assess the object's condition and condition through its own examination of the item before the auction. Olséns Auktioner is not responsible under any circumstances for natural wear and tear, minor damage and defects, possible feeding of canvases, condition of frames, natural changes in living materials such as bleaching of paper and cracks in wood.

8.2 Clocks and timepieces are sold as works of art and Olséns Auktioner is not responsible for their technical function as a timer. The function of mechanical or electrified / battery-powered objects is not responsible.

8.3 Information provided regarding, for example, the author, authenticity, age, technology, provenance or condition only serves as guidance for the buyer in his examination of the object. Olséns Auktioner is not responsible for such information being incorrect unless the incorrect information was provided through gross negligence.

8.4 Imaging of objects takes place only for identification purposes. Olséns Auktioner is not responsible for damages or deficiencies that are not apparent from such an image.

8.5 Items are sold in accordance with the description provided. Olséns Auktioner reserves the right to change such description. Such change is specified separately.

8.6 Olséns Auktioner has the right to remedy such defects in sold items for which Olséns Auktioner is responsible. If remediation does not take place within a reasonable time from the time a complaint regarding a defect is made, the buyer is entitled to cancel the purchase and upon return of the item receive the amount paid to Olséns Auktioner at the time of purchase. The buyer is not entitled to any additional compensation.

8.7 Any defects must be reported immediately after the buyer has discovered or discovered the defect, but no later than 7 days after the auction day. Complaints regarding information about the author as stated in section 8.3 must, however, be made no later than 3 years from the purchase.

8.8 Olséns Auktioner's liability for errors is limited to what is stated in these terms.

8.9 Olséns Auktioner does not guarantee that the services on olsensaujoner.se are constantly available. Olséns Auktioner is not responsible for any inconvenience or financial effects that affect customers due to the bidding function or other functions not being available at all times.

9. RIGHT OF WITHDRAWAL

9.1 Buyers who are consumers have the right to withdraw in accordance with the Act (2005: 59) on distance contracts and contracts outside business premises. Exceptions from the right of withdrawal specified in the said law are fully applied to purchases.

9.2 Purchases must be canceled within the withdrawal period, which is a period of time that runs for 14 days from the day the buyer receives the purchased item in his possession. Notice of a canceled purchase must be submitted to Olséns Auktioner in writing via email or letter within the withdrawal period. 10. DELIVERY DELAY

10.1 If the delivery delay due to circumstances for which Olséns Auktioner is responsible lasts more than 20 working days and is of significant importance to the buyer and Olséns Auktioner does not realize this, the buyer may by written notice to Olséns Auktioner cancel the purchase and receive the amount paid to Olséns Auktioner at the time of purchase. . The buyer is not entitled to any additional compensation.

10.2 Olséns Auktioner's liability in the event of delay is limited to what is stated in these terms.



11. FORCE MAJEURE


Olséns Auktioner is exempt from the penalty for failure to fulfill a certain obligation under this agreement if the failure is based on a circumstance of the type set out below and the circumstance prevents or significantly impedes the timely fulfillment thereof. Relieving circumstances shall be considered, among other things, acts of war, currency restrictions, shortage of means of transport, fire, government action, amended legislation, employee conflict, general shortage of goods, restrictions on driving force, accidents or similar circumstances. If Olséns Auktioner's fulfillment of a certain obligation is delayed by more than three months due to a liberating circumstance, the buyer has the right to cancel the purchase in writing without obligation to pay compensation.



12. DISPUTE

Disputes regarding these conditions shall be settled in accordance with Swedish law in a court in Sweden.
